1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and WeStory.ai Inc. ("WeStory", "we", "us", or "our"). By creating an account, recording video or audio interviews, accessing our web platform, or using our campaign tools, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility & Account Responsibilities

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to establish an account on WeStory. Accounts created on behalf of family members, elderly parents, or grandparents must be managed by an authorized adult account holder.

You are solely responsible for maintaining the confidentiality of your credentials and for all activities conducted through your account. You agree to notify WeStory immediately upon discovering any unauthorized security breach or account compromise.

3. User Content Ownership & Service License

You retain 100% full ownership, copyright, and intellectual property rights over all recorded video clips, audio tracks, family photos, story transcriptions, and custom text inputs submitted to or created through WeStory ("User Content").

Solely to enable us to operate the platform, process transcripts, and format PDF story exports, you grant WeStory a limited, non-exclusive, worldwide, royalty-free license to host, store, stream, reproduce, transcribe, and display your User Content strictly for you and your explicitly invited family members or collaborators.

4. AI Processing, Voice Integrity & User Verification

WeStory uses automated AI speech-to-text engines and story organization models. While we utilize enterprise-grade translation and transcription pipelines, automated outputs may occasionally misinterpret spoken accents, proper names, or regional idioms.

5. WeStory Studio & Commercial Scouting Program

Participation in the WeStory Studio & Commercial Adaptation Program is entirely optional and managed strictly via your account setting controls.

• If you explicitly opt-in, WeStory may evaluate anonymized story summaries for potential documentary, publishing, or film development opportunities.
• No commercial agreement or adaptation will proceed without a separate, written legal contract executed directly by you, guaranteeing final creative approval and a net creator revenue share (up to 70%).
• Accounts that do not opt-in remain completely private within your family vault.

6. Subscriptions & Payments

Subscriptions: Paid plan subscriptions automatically renew on a monthly or annual billing cycle until canceled. Cancellations take effect at the end of the current billing period.

7. Recording Consent, Permissible Conduct & Compliance

You represent and warrant that you possess all legal rights and necessary consents required under applicable wiretapping and privacy laws prior to recording audio or video of any individual.

You agree not to upload, store, or transmit content that:

• Infringes on third-party intellectual property, privacy, or publicity rights.
• Is illegal, defamatory, obscene, or contains non-consensual recordings.
• Attempts to breach system security, reverse-engineer cloud workflows, or bypass API access restrictions.

8. Account Termination & Deletion Protocol

You may terminate your account at any time through Account Settings. Deletion follows our mandatory two-step verification Hard-Delete protocol as described in our Privacy Policy.

9. Warranty Disclaimers & Limitation of Liability

Services provided "AS IS" and "AS AVAILABLE"

To the maximum extent permitted by applicable law, WeStory.ai Inc. disclaims all warranties, express or implied. WeStory shall not be held liable for indirect, incidental, special, or consequential damages, or any loss of personal media, transcripts, or data arising out of your use of the platform. Our cumulative aggregate liability shall not exceed the total amount paid by you to WeStory in the twelve (12) months preceding the claim (or $100 USD, whichever is greater).

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal suit, action, or proceeding arising under or relating to these Terms shall be instituted exclusively in the state or federal courts located in Santa Clara County, California.
